Food license is a prerequisite for establish a restaurant

Various types of business licences relating to foodare issued by the Food and Environmental HygieneDepartment. The “General Restaurant Licence” allows the licensee to cook and sell any kind of food for consumption in the restaurant. The “Light refreshment Restaurant Licence” only allows the licensee to prepare and sell one types of food contained in the “List of Foods Approved Food Items for Light Refreshment Restaurants ” for consumption by customers in the restaurant. If the food industry is involved in the manufacture or preparation of food, the sale of food for people to eat outside the food industry, a “Food Factory licence” is required.  Any restaurant licensed on premises that sells alcohol for consumption on the premises must first apply a liquor license.  Any restaurant licensed to sell liquor in a place fordrinking in the scope of the restaurant licence must first apply for a liquor licence.

Under the Food Business Regulation (Cap. 132X), “restaurant” means a food business involving the sale of meals or non-bottled non-alcoholic beverages (other than herbal tea) for consumption or consumption on its premises, excluding factories Cafeterias or businesses operated by hawkers who have a licence granted under the Hawker Regulation (Cap 132AI). In addition, restaurant operators must obtain a restaurant licence issued by the licensing authority before opening. The Director of Food and Environmental Hygiene is the “licensing authority” for restaurants throughout Hong Kong.

According to the laws of Hong Kong, anyone who wishes to bake bread and other baked goods for sale in buildings in Hong Kong must apply for a bakery bread restaurant license from the licensing authority before opening. If you are baking bread and other foods in a licensed general restaurant for customers to eat in the restaurant, you do not need to apply for a separate bakery bread restaurant license. If the above food is baked in a snack restaurant for customers to eat in the restaurant, they must apply for a baked bread restaurant license separately. If you have a separate counter / separate corner in a licensed restaurant (including general restaurants and snack restaurants) for retail sale of bread and other baked goods baked in the restaurant, you must also apply for a bakery bakery license.

According to Hong Kong law, anyone who wishes to operate a factory canteen in a building in Hong Kong must apply for a factory canteen license from the licensing authority before opening. Factory canteen refers to the food business operating in a factory building. The business nature is to sell or supply meals or non-alcoholic non-bottled drinks (excluding herbal tea) to workers employed in any factory in the building for Eat inside.

During public events (such as exhibitions, performances, sports competitions, concerts, etc.), pre-cooked food is reheated and sold in the form of temporary stalls / kiosks for off-site consumption. The food business involves preparation of food for sale outside the food business (but not including frozen confectionery factories, dairy factories or hawkers licensed under the Hawker Regulation (Cap. 132AI) Business) must apply to the Director of Food and Environmental Hygiene for a food factory licence. Many food cooking and manufacturing industries in Hong Kong are required to apply for a food factory licence. 

Operating food businesses involving the sale of fresh, frozen or refrigerated beef, lamb, pork, reptiles (including live reptiles), fish (including live fish) or poultry (including live poultry), but excluding restaurants, factory canteens, market stalls Or a business operated by a hawker holding a licence under the Hawker Regulation (Cap. 132AI) must apply for a fresh provision shop licence from the Director of Food and Environmental Hygiene.

A food business that is involved in the processing or reproduction of milk or milk beverages under the Dairy Regulations (Cap. 132AQ) must obtain a dairy factory licence from the Director of Food and Environmental Hygiene before opening. However, if milk is processed or reconstituted in a restaurant licensed under the Food Industry Regulations (Cap. 132X) or reconstituted milk or milk beverage for customers to drink in the restaurant, no separate application is required Dairy factory license.

Food businesses (excluding restaurants, factory canteens or businesses operated by hawkers licensed under the Hawker Regulation (Cap. 132AI)) that involve selling siu-mei or lo-mei in retail form The Director of Food and Environmental Hygiene applies for a siu mei and lo mei shop licence. As for restaurant licensees selling siu mei and lo mei on premises, they only need to obtain the approval of the FEHD and attach an endorsement on their licences permitting the sale of these foods.
